Why Two Minds Mediation?
Two Minds Mediation’s name was derived from the idea that in any mediation, there is a need to balance two opposing positions and get both parties to focus on a range of potential outcomes and meet to form a productive way forward. All parties, while initially competing for an outcome, will be required to be open to adjusting their positions, motivations and desired result to understand how the other thinks and how to overcome the conflict. Equally, “two minds” reflects both our founders, whose experience and approaches help resolve disputes in a calm, collaborative and constructive way.
What is mediation, and how can it help resolve my conflicts?
Mediation is a facilitated process where a neutral specialist guides parties in conflict towards a mutually agreeable solution through open communication and negotiation.
How do I know if mediation is the right choice for my situation?
Mediation is effective for various conflicts, including workplace issues, family disputes, business disagreements, and more. It's ideal when parties seek a collaborative resolution rather than adversarial litigation.
Will the mediation process be confidential?
Yes, confidentiality is a cornerstone of mediation. Discussions and information shared during mediation sessions are kept confidential, promoting open dialogue.
Should I get legal advice?
Two Minds Mediation will explain the mediation process in detail prior to your mediation, to prepare you for the session. While you do not normally need to seek legal advice or representation during mediations, depending on the circumstances of your case, you may prefer to understand your legal position and seek counsel before, during, and after mediation sessions to ensure your interests are protected. You may be referred to an external organisation for some legal advice prior to the mediation if necessary. Additionally, sometimes parties choose to formalise agreements through their legal representatives after the mediation session.
What role does the mediation specialist play in the process?
The mediator acts as a neutral guide, facilitating communication, exploring solutions, and helping parties make informed decisions about the potential outcomes and consequences.
How much does mediation cost?
Costs vary based on factors like the complexity of the conflict and the mediator's rates. It's often more cost-effective than going to court.
What happens if we can't reach an agreement through mediation?
While the goal is resolution, if an agreement isn't reached, parties still have the option to pursue other avenues such as arbitration or litigation.
Can your mediator decide the outcome for us?
Our mediators will not make a decision or give a judgment about the way they believe the dispute should be resolved. The mediators at Two Minds Mediation will manage the process and assist you to reach a mutual agreement between the parties.
How long will the mediation take?
Mediations are assessed on a case by case basis, and depending on the issues and situations you present, may be more complex. However, as a ballpark, mediations usually take 3-4 hours. It is important to ensure that you have set aside enough time for the mediation and make the necessary arrangements so that you are able to stay for the entire session.
What are the potential benefits of choosing mediation over traditional litigation?
Mediation offers quicker resolutions, cost savings, more control over outcomes, preservation of relationships, and a private and confidential process.

Our mediators are nationally accredited under the National Mediator Accreditation Standards and are accredited with nationally recognised bodies. Additionally, our mediators come with wide ranging professional backgrounds, which allows us to match mediator expertise with each case, utilise our experience and draw on our communication skills and skillset to understand the complexities of your matter and help resolve your dispute.

We will evaluate the details of your issue and ensure transparency and clarity by outlining the service we provide. We will do this by addressing the following:

  1. Understanding the nature of your conflict: we will get a detailed overview of your situation by listening to the nature of the issues, parties involved, and their respective viewpoints, allowing us to understand the context and complexities of the dispute.
  2. Identifying stakeholders and dynamics: this is to learn about the relationships between the parties involved and any power dynamics that may be at play. We need to understand the level of communication between the parties and whether any underlying tensions or misunderstandings exist.
  3. Outlining our role and expectations: this covers our role as a mediator, your expectations and desired end result, our process, and explain potential outcomes. This discussion will help us gauge whether our involvement aligns with your expectations and our obligations.
