Personal mediation overview

Two Minds Mediation is adept in navigating disputes in areas of construction, property and some sensitive family matters, excluding dissolution of marriages and child custody disputes.

Enlisting the expertise of a skilled mediator can prove successful for achieving effective resolutions when it comes to resolving personal conflicts.

Our team utilises its combined 40+ years experience and brings a pre-existing skill set managing disputes in every sector to help navigate intricate challenges involving personal dynamics across a wide range of matters.

Our process encourages better communication, collaboration and interests based decision making among the parties involved. This fosters a conducive environment for reaching practical solutions while maintaining the integrity of working relationships and building communication by giving all stakeholders an opportunity to voice their issues and listen to each other’s concerns, ultimately leading to better outcomes and stronger relationships in the long term.

Our process can help you remain focused on the core issues, facilitating quicker agreements and deftly circumventing potentially unnecessary adversarial interactions, and promoting equitable settlements.

Key service areas

Construction, strata, and residential

There are a wide range of problems that mediation is suitable for. For example, builder-homeowner disputes around construction quality, payment disagreements, and material choices; tenants may consider using a neutral mediator to resolve disputes with a landlord if negotiation fails; and neighbours may use mediation to resolve issues around pets, noise, and other residential challenges.

Wills and estates

Resolve emotional estate disputes and conflicts involving trustees and beneficiaries amicably with mediation, preventing unnecessary, prolonged family discord. Expert-guided estate mediation serves as a pragmatic means to achieve amicable resolutions and maintain family relationships outside the courtroom, while fostering co-operation and helping provide families with peace of mind and closure.

Guardian and elder mediation

Elder mediation fosters co-operative family decision-making, focusing on the elder’s voice and dignity. The process for elders and their families ensures a respectful, solution-focused discussion. It empowers seniors to address various life decisions, enhancing relationships through understanding and collaboration. The process respects existing orders like Guardianship and Power of Attorney, aiming to optimise quality of life and relationships.

Personal injury

Mediation offers an alternative to intense courtroom battles in personal injury disputes. It involves structured negotiations guided by an impartial mediator to achieve a mutually agreeable resolution as an alternative to traditional litigation. It is a cost-effective and efficient solution for resolving personal injury cases while fostering communication and collaboration among the parties.
Note: we do not mediate on disputes involving families and children. Please contact a family dispute resolution mediator.

Two Minds Mediation Methodology

Our approach is designed to empower you to address the challenges between the parties involved through facilitating discussion, exploring the conflict in depth and seeking to reach a mutually beneficial solution that allows you to move forward.

Initial exploration
We start by initiating a comprehensive discussion to understand the core issues and individuals' perspectives involved in the conflict. We analyse all perspectives closely, uncovering the underlying values, motivations, ideas, or desires that have contributed to the conflict. We help all parties understand the various viewpoints and foster understanding and empathy among all parties.
Private sessions
After the initial exploration, we meet with both parties individually in a private and confidential setting. This allows each party to speak openly, scrutinise perspectives that have been identified and discuss objectives and potential outcomes, all in a trusted space.
Outline solutions and reality testing
When the parties reconvene, we facilitate dialogue to ensure solutions are proposed, discussed, scrutinised and reality tested. All perspectives and potential consequences are considered and analysed, with the goal being to agree a roadmap forward.
Next steps
Where optimal solutions are identified and an agreement is reached, we craft a clear and actionable resolution plan and put the main provisions in writing in the form of a Deed of Agreement, which all parties will sign. In circumstances where the parties don't reach an agreement, we assist the parties to determine whether it would be beneficial to convene again and continue negotiations, or explore other resolution alternatives.

What you can expect at your first inquiry

We will evaluate the details of your issue and ensure transparency and clarity by outlining the service we provide. We will do this by addressing the following:

  1. Understanding the nature of your conflict: we will get a detailed overview of your situation by listening to the nature of the issues, parties involved, and their respective viewpoints, allowing us to understand the context and complexities of the dispute.
  2. Identifying stakeholders and dynamics: this is to learn about the relationships between the parties involved and any power dynamics that may be at play. We need to understand the level of communication between the parties and whether any underlying tensions or misunderstandings exist.
  3. Outlining our role and expectations: this covers our role as a mediator, your expectations and desired end result, our process, and explain potential outcomes. This discussion will help us gauge whether our involvement aligns with your expectations and our obligations.
By addressing these points, we can assess whether mediation is the best process to resolve your conflict, outline next steps where appropriate, and begin to create a vision for your future.
